Terms & Conditions

Welcome to Access Self Storage Hurley. These Terms & Conditions explain the general terms governing your use of our self-storage facilities, website, online rental services, tenant portal, payment services, and related services.

By renting a storage unit, submitting a rental application, making a payment, accessing your tenant account, or using our facilities, you acknowledge that you have read and agree to these Terms & Conditions, together with the applicable Rental Agreement and facility rules.

If there is any conflict between these Terms & Conditions and your signed Rental Agreement, the Rental Agreement will control.

1. Storage Rental

Access Self Storage Hurley provides self-service storage space for the storage of personal property, household goods, business property, and other permitted items.

A storage unit is rented for storage purposes only. Storage units may not be used as residences, living quarters, offices, workshops, or for any other purpose not permitted by the Rental Agreement.

Your rental begins when your Rental Agreement becomes effective and continues according to the terms of that agreement until properly terminated.

The specific unit size, monthly rent, fees, payment due date, access information, and other applicable terms will be provided in your Rental Agreement and/or tenant account.

2. Tenant Responsibility

You are responsible for the property you place in your storage unit.

You are responsible for:

• Selecting a unit of appropriate size for your needs.

• Properly packing, protecting, and securing your belongings.

• Keeping your unit locked with an appropriate lock.

• Maintaining accurate contact information with Access Self Storage Hurley.

• Making all payments when due.

• Following all facility rules and applicable laws.

• Removing all personal property when your rental ends.

Access Self Storage Hurley does not inspect, supervise, or take custody of the contents of individual storage units.

3. Prohibited Items and Activities

You may not store or use a storage unit for any unlawful, hazardous, or prohibited purpose.

Unless specifically authorized in writing, prohibited items include, but are not limited to:

• Illegal drugs or controlled substances.

• Explosives, fireworks, or other hazardous materials.

• Flammable or highly combustible materials.

• Toxic, corrosive, radioactive, or environmentally hazardous materials.

• Perishable food or other items likely to attract pests.

• Living animals or plants.

• Stolen property or property connected with unlawful activity.

• Property that creates an unreasonable risk of damage to the facility or other tenants.

• Any item prohibited by applicable federal, state, or local law.

No person may live or sleep in a storage unit.

No business, mechanical work, repairs, construction, or other activity that creates a nuisance, hazard, excessive noise, or risk of damage may be conducted in or around a storage unit.

Access Self Storage Hurley reserves the right to take action when prohibited activities or materials are discovered, subject to applicable law and the Rental Agreement.

4. Rent and Other Charges

Rent and other charges are due according to the payment schedule established in your Rental Agreement.

You are responsible for ensuring that your payment method remains current and that sufficient funds are available when payment is due.

Applicable charges may include, where permitted by the Rental Agreement and applicable law:

• Monthly rental charges.

• Late fees.

• Administrative or other disclosed fees.

• Costs associated with unpaid accounts.

• Costs associated with preservation, removal, storage, preparation for sale, disposal, or sale of property when permitted by law.

• Other charges specifically identified in your Rental Agreement.

Access Self Storage Hurley may change rental rates and other charges as permitted by the Rental Agreement and applicable law.

5. Delinquent Accounts and Access

If your account becomes delinquent, Access Self Storage Hurley may exercise the rights and remedies provided by your Rental Agreement and applicable law.

These remedies may include restricting access to your unit, applying applicable fees and charges, and exercising a lien against property stored in the unit when permitted by law.

For Wisconsin self-service storage facilities, state law provides specific requirements concerning liens, notices, redemption, and the sale or disposal of stored property following default. Those procedures will be followed as required by applicable law.

Your property may be subject to a statutory or contractual lien for unpaid rent and other lawful charges.

6. Security and Access

Access Self Storage Hurley takes reasonable measures to maintain the facility and its access systems; however, no storage facility can guarantee that theft, vandalism, weather-related events, water intrusion, pest activity, or other loss or damage will never occur.

Your access credentials, gate codes, keys, and/or other means of accessing the facility are your responsibility. Do not share access information with unauthorized persons.

Access may be limited or suspended when required for maintenance, emergencies, security concerns, delinquent accounts, violation of the Rental Agreement, or other circumstances permitted by law.

7. Protection of Your Property

You are responsible for protecting and insuring your own property.

Access Self Storage Hurley does not provide insurance for your stored belongings unless specifically stated in your Rental Agreement.

You should maintain appropriate insurance or other protection for the full value of the property you store.

Because storage units are not climate-controlled living or commercial spaces unless specifically identified as such, property may be exposed to changes in temperature and humidity and other environmental conditions.

You should take appropriate precautions when storing items that may be affected by moisture, temperature changes, pests, or other environmental conditions.

8. Vehicles and Other Property

Vehicles, trailers, boats, recreational equipment, or other large property may only be stored in areas specifically designated and rented for that purpose.

Any vehicle or other property stored at the facility must comply with the requirements stated in the applicable Rental Agreement and facility rules.

No vehicle may be operated, repaired, dismantled, or maintained on the property except as specifically permitted by Access Self Storage Hurley.

9. Cleanliness and Maintenance

Tenants are responsible for keeping their storage unit and the surrounding area clean and free of trash, debris, spills, and other materials.

Nothing may be placed in hallways, driveways, access lanes, or other common areas.

Tenants may be responsible for costs resulting from damage, excessive cleaning, removal of abandoned property, or other conditions caused by the tenant or the tenant's property, to the extent permitted by the Rental Agreement and applicable law.

10. Damage to the Facility

Tenants are responsible for damage caused by themselves, their guests, their vehicles, or their stored property.

You may not alter, modify, drill into, paint, attach fixtures to, or otherwise modify your storage unit or any part of the facility without prior written authorization.

Any damage should be reported to Access Self Storage Hurley promptly.

11. Guests and Authorized Persons

You are responsible for the conduct of anyone you allow to access your storage unit or the facility.

You are responsible for ensuring that guests and authorized persons comply with these Terms & Conditions, the Rental Agreement, and all facility rules.

Access Self Storage Hurley may require verification of identity or authorization before allowing access to a storage unit or tenant account.

12. Online Rentals and Tenant Portal

Access Self Storage Hurley may provide online services that allow customers to:

• View available units.

• Join a waiting list.

• Submit rental applications.

• Complete rental paperwork.

• Make payments.

• Access tenant account information.

• Receive account communications.

• Manage certain account information.

Availability of online features may change from time to time.

Submitting an online rental application or reservation does not necessarily create a completed rental agreement unless and until all required steps have been completed and the Rental Agreement has been accepted by both parties.

13. Online Payments

When making a payment online, you authorize the payment method you provide to be charged for the amount presented to you and authorized under your Rental Agreement.

You are responsible for reviewing payment information before submitting a transaction.

Access Self Storage Hurley is not responsible for delays or failures caused by a customer's bank, card issuer, payment processor, internet service provider, or other third party.

14. Waiting List

When storage units are unavailable, Access Self Storage Hurley may offer a waiting-list option.

Joining a waiting list does not guarantee that a specific unit, unit size, price, or availability date will become available.

When a suitable unit becomes available, customers on the waiting list may be contacted according to the facility's current waiting-list procedures.

15. Termination and Move-Out

Your rental may be terminated according to the notice and termination requirements contained in your Rental Agreement.

When moving out, you must:

1. Remove all personal property from the unit.

2. Remove all trash and debris.

3. Leave the unit in the condition required by the Rental Agreement.

4. Follow the facility's move-out instructions.

5. Return any required keys, access devices, or other property belonging to Access Self Storage Hurley.

Leaving property behind does not necessarily terminate your financial obligations under the Rental Agreement.

16. Abandoned Property

Property left in a storage unit after termination of the rental may be treated as abandoned and handled according to the Rental Agreement and applicable law.

Access Self Storage Hurley may exercise any rights available under applicable law concerning abandoned property, unpaid rent, liens, removal, disposal, or sale.

17. Limitation of Liability

To the maximum extent permitted by applicable law and subject to the Rental Agreement, Access Self Storage Hurley is not responsible for loss of or damage to stored property resulting from circumstances beyond its reasonable control, including but not limited to theft, burglary, vandalism, fire, water intrusion, storms, severe weather, pests, mold, mildew, temperature or humidity changes, or acts of other tenants or third parties.

Nothing in these Terms & Conditions is intended to waive or limit any right or protection that cannot legally be waived or limited under applicable law.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, damages, losses, costs, or expenses resulting from your use of the facility, your storage unit, your property, or the actions of you or your guests, except to the extent caused by the negligence or wrongful conduct of Access Self Storage Hurley or otherwise prohibited by law.

19. Changes to These Terms

Access Self Storage Hurley may update these website Terms & Conditions from time to time.

The most current version will be posted on our website with the effective date shown above.

Changes to an existing Rental Agreement will be handled according to the terms of that agreement and applicable law.

20. Website and Online Services

We make reasonable efforts to keep our website and online services available and accurate, but we do not guarantee that the website will always be available, uninterrupted, error-free, or completely current.

Unit availability, pricing, promotions, and other information displayed online may change without notice.

Submitting information through our website does not guarantee that a particular unit will remain available until the rental process is completed.

21. Privacy and Communications

By providing your contact information, you agree that Access Self Storage Hurley may use that information to communicate with you regarding your account, rental, payments, facility access, notices, maintenance, security, and other matters related to your storage rental.

You are responsible for keeping your mailing address, telephone number, and email address current.

Certain notices may be required to be delivered in a particular manner under applicable law regardless of your communication preferences.

22. Compliance With Laws

You agree to comply with all applicable federal, state, and local laws, ordinances, regulations, and facility rules.

Access Self Storage Hurley may take appropriate action when a tenant's conduct violates applicable law, the Rental Agreement, or facility rules.

23. Governing Agreement and Law

Your use of a storage unit is governed primarily by your Rental Agreement. The Rental Agreement, these Terms & Conditions, and applicable facility rules should be read together.

The laws of the state in which the storage facility is located govern the rental relationship, except where applicable law requires otherwise.

24. Severability

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
